DISTANCE SALES AGREEMENT – PRE-INFORMATION FORM

The subject of this Distance Sales Agreement Pre-Information Form is to determine the rights and obligations of the parties in accordance with Law No. 6502 on the Protection of Consumers and the Distance Sales Regulation regarding the information, quantity, and delivery of the product(s) sold by the SELLER on its e-commerce website, the sales price of which is specified below. By accepting this pre-information form, the BUYER acknowledges and undertakes that they have approved the order subject to the contract, learned the basic features of the product subject to the order, assumed responsibility for paying the price of the product subject to the order, including shipping costs, taxes, and fees if any, and have been accurately and fully informed in this regard.

GENERAL PROVISIONS

The BUYER can place an order by VISA, Mastercard, or Bank wire transfer/EFT when purchasing products from the e-commerce site. Payment conditions other than those specified are not accepted by the SELLER. If the BUYER chooses the bank wire transfer/EFT option for payment, payment must be made within 3 (three) days at the latest. Otherwise, the order will be canceled by the SELLER. The delivery period starts when the payment made by the BUYER is credited to the SELLER's account. VAT is included in the price of products offered for sale by the SELLER on the e-commerce site. The SELLER has determined product prices in Turkish Lira. The SELLER will deliver the ordered products with their invoice.

If the price of the product ordered on the e-commerce site by the SELLER is incorrect, the correct price will be notified to the BUYER in writing via e-mail/fax/GSM, and the sale will be made at this price.

If the product subject to the contract is not delivered within the legal maximum period of 30 days due to force majeure (adverse weather conditions, epidemic, heavy traffic, earthquake, flood, fire, etc.) without the fault of the SELLER or due to extraordinary circumstances preventing delivery, the SELLER is obliged to notify the BUYER within 3 (three) days from the date they learn of the situation.

While the SELLER keeps many of the products it sells in stock, some products are operated without stocking. If the product cannot be supplied by the SELLER within 30 (thirty) days, the BUYER is informed of the situation. If the BUYER cancels the order, the contract amount is refunded by the SELLER.

The BUYER's credit card/bank card account information is not recorded on our e-commerce site. The SELLER directs the BUYER to the bank system according to their choice during the payment process, does not manage the bank transaction, and does not intervene in the payment process in any way. The SELLER is not responsible for disputes that may arise between the BUYER and the relevant Bank.

For the delivery of the product, it is mandatory to confirm this Pre-Information Form electronically. If the product price is not paid for any reason or is canceled in bank records, the SELLER is deemed to be relieved of the obligation to deliver the product.

DELIVERY

The delivery costs of the product subject to the contract are covered by the SELLER. Delivery is made to the address specified by the BUYER within 15 days at the latest after the contract price is paid to the SELLER by the BUYER. If the contract price is not paid by the BUYER, the SELLER has no delivery obligation. Delivery is made through the cargo companies with which the SELLER works. At the time of delivery, the cargo delivery receipt must be signed by the BUYER.

In cases where the cargo package is torn, damaged, spoiled, or the product is clearly broken/damaged/defective at the time of delivery, the BUYER must prepare a damage assessment report with the personnel of the relevant cargo company. The SELLER has no responsibility once the BUYER takes delivery of the cargo without preparing a damage assessment report.

RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract without giving any reason, provided that the product subject to the contract is not used, within 14 days from the date of delivery to them or to the person and/or organization at the address they indicated. In case of exercising the right of withdrawal, the product subject to the contract must be sent to the SELLER's address within 14 days, with the shipping costs borne by the BUYER. The burden of proof that the right of withdrawal has been exercised belongs to the BUYER.

For the return process, the product must be delivered complete and undamaged with its box, packaging, warranty certificate, user manual, and standard accessories, if any. In case of exercising the right of withdrawal, the cargo delivery receipt regarding the return of the product and the original invoice must be sent to the SELLER in accordance with the Tax Procedure Law. If the original invoice is not sent by the BUYER, the withdrawal process will not be accepted by the SELLER.

There is no right of withdrawal for goods prepared in line with the BUYER's special requests or personal needs; for goods whose protective elements such as packaging, tape, seal, package have been opened after delivery and whose return is not suitable for health-hygiene reasons; for goods or services whose price changes depending on fluctuations in financial markets. In addition, product returns are not accepted for campaign and promotional products specially prepared for the BUYER for specific days such as New Year, holidays, Mother's Day.

The BUYER is obliged to provide their member login information (name-surname, TR ID/Tax ID numbers), delivery address, GSM and landline numbers accurately and completely, declaring and accepting that they have given consent under Law No. 6698 on the Protection of Personal Data.

AUTHORIZED COURT

In case of disputes, Istanbul Consumer Arbitration Committees and Istanbul Consumer Courts are authorized in accordance with Law No. 6502 on the Protection of Consumers.

The BUYER who approves this Pre-Information Form has been informed of all terms, understood them, and accepted the specified information and rules.
